Student Records

A cumulative record (also called a transcript), whether recorded by handwriting, print, tapes, film, microfilm or other means, must be maintained on the history of a student’s development and educational progress. The school district will protect the privacy of such records. Parents/guardians have the right to:

  • inspect and review the student’s educational record maintained by the school,
  • request that a school correct records that they believe to be inaccurate or misleading, and
  • have some control over the disclosure of information from educational records.

School officials with legitimate educational interests may access student records without parental consent as long as the official needs to review the records in order to fulfill his/her professional responsibility. Upon request from officials of another school district in which a student seeks or intends to enroll, the district shall disclose educational records without parental consent.

A parent's request to access their student’s educational records must be submitted in written form to the school custodian of records, and the school custodian of records will have five (5) business days from the date of receipt of the request to provide access to the records. Copies of student records are available to parents for a fee of $0.25 per page.

Un expediente acumulativo, ya sea grabado a mano, impreso, en casete, film, microfilm o de otra forma, debe ser mantenido en el historial del desarrollo y del progreso educacional del estudiante. El distrito escolar protegerá la privacidad de dichos expedientes. Los padres y tutores legales tienen el derecho de:

  • inspeccionar y revisar el expediente educacional del estudiante mantenido en la escuela
  • solicitar que la escuela corrija el expediente que ellos creen son incorrectos o confusos, y
  • tener un poco de control sobre la revelación de la información del expediente educacional.

Los administradores escolares con intereses legítimos educacionales pueden tener acceso al expediente del estudiante sin el consentimiento de los padres, siempre y cuando el administrador necesite revisar el expediente para poder cumplir con su responsabilidad profesional. Al recibir la solicitud de los administradores de otro distrito escolar en el cual el estudiante busca o intenta ser inscrito, el distrito deberá revelar el expediente educacional sin el consentimiento de los padres.

La solicitud de los padres para tener acceso al expediente educacional de su hijo o hija deberá ser sometida por escrito a la persona encargada de los expedientes en la escuela, y dicha persona tendrá cinco (5) días hábiles desde la fecha en que se recibió la solicitud para proporcionar el expediente. Copias del expediente del estudiante se encuentran disponibles para los padres por una tarifa de $0.25 por página.

IMPORTANT INFORMATION REGARDING CONFIDENTIAL STUDENT DATA

A recent lawsuit against the California Department of Education (CDE) is impacting all school districts in California. The lawsuit does NOT directly involve the Simi Valley Unified School District.

In April 2012, two organizations, the Morgan Hill Concerned Parents Association and the Concerned Parents Association, filed a lawsuit against the CDE alleging widespread, systemic non-compliance by local education agencies with special education laws. The suit alleges the CDE fails to monitor, investigate and correct such non-compliance in accordance with the law. The CDE denies these allegations and is actively defending the litigation.

The Simi Valley Unified School District is not involved in the lawsuit and is not subject to the suit's allegations. In addition, the Simi Valley Unified School District will NOT release any student data or information about students regarding this matter.

Nonetheless, as part of this lawsuit, CDE has been ordered by the court to release all data it has collected on general and special education students since January 1, 2008.

INFORMACIÓN IMPORTANTE CON RESPECTO AL ARCHIVO CONFIDENCIAL DE UN ESTUDIANTE

Una demanda reciente en contra del Departamento de Educación de California (CDE, por sus siglas en inglés) está afectando a todos los distritos escolares. La demanda NO tiene nada que ver con el Distrito Escolar Unificado de Simi Valley.

En abril de 2012, dos organizaciones, la Asociación de Padres Preocupados Morgan Hill (Morgan Hill Concerned Parents Association) y la Asociación de Padres Preocupados (Concerned Parents Association), presentaron una demanda en contra de CDE alegando incumplimiento sistemático general de parte de las agencias locales de educación con leyes de educación especial. La demanda también alega que CDE no cumple con monitorear, investigar y corregir dicho incumplimiento de acuerdo con la ley. CDE niega los alegatos y está defendiendo el litigio en forma activa.

El Distrito Escolar Unificado de Simi Valley no está involucrado en la demanda ni está sujeto a los alegatos de la demanda. Además, el Distrito Escolar Unificado de Simi Valley NO hará pública ninguna información sobre estudiantes con respecto a este asunto.

Sin embargo, como parte de esta demanda, el CDE ha sido ordenado por el juez a hacer pública toda la información colectada desde el 1 de enero de 2008 de estudiantes en educación general y especial.
